These Terms & Conditions govern your use of vivantalove.com and purchases from Vivanta Love. By using the website or placing an order, you agree to these terms. If you do not agree, do not use the website.
1. Eligibility and account responsibility
You must be legally capable of entering a binding agreement in your location. You are responsible for accurate account information, maintaining the confidentiality of login credentials, and activities under your account.
2. Products and availability
We try to display products, colors, descriptions, dimensions, and prices accurately, but reasonable variations or errors may occur. Products and availability may change without notice. We may limit quantities, discontinue items, correct errors, or refuse orders where permitted by law.
3. Orders and acceptance
An order confirmation acknowledges receipt of an order; it does not necessarily mean the order has been accepted. Acceptance occurs when we begin fulfillment or otherwise confirm acceptance. We may request additional information or cancel an order for the reasons described in these terms.
4. Prices, taxes, and payment
Prices are shown in the currency displayed at checkout and may change without notice. Applicable taxes, shipping fees, discounts, and other charges will be shown before payment where required. You authorize the chosen payment provider to charge the total shown at checkout.
5. Personalized products
You are responsible for reviewing personalization details before purchase and for having the rights to submitted content. Personalized items are not returnable except where damaged, defective, incorrect, or otherwise protected by law. The Personalized Products Policy is incorporated into these terms.
6. Shipping, returns, and cancellations
The Shipping & Delivery Policy, Returns & Refunds Policy, and Order Cancellation & Changes Policy are incorporated into these terms. Production takes 2–3 business days, followed by estimated shipping of 6–14 business days.
7. Acceptable use
You may not misuse the website; interfere with its security or operation; attempt unauthorized access; introduce malicious code; scrape or copy content without permission; use the website for fraud or unlawful conduct; infringe another party’s rights; or submit unlawful, harmful, deceptive, hateful, obscene, threatening, or defamatory content.
8. Intellectual property
The website and its original text, branding, graphics, designs, photographs, product displays, software, and other content are owned by or licensed to Vivanta Love and are protected by applicable intellectual-property laws. No rights are granted except the limited right to use the website for personal shopping.
9. Reviews and submissions
If you submit a review, comment, image, or other non-personalization content, you confirm that it is truthful, lawful, and yours to submit. You grant Vivanta Love a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and adapt that submission for operating and promoting the business, subject to applicable privacy law. We may remove submissions that violate these terms.
10. Third-party services
Third-party links and services are provided for convenience. Vivanta Love does not control and is not responsible for third-party content, terms, security, availability, or privacy practices.
11. Disclaimer of warranties
To the fullest extent permitted by law, the website and products are provided “as is” and “as available,” without warranties not expressly stated. Nothing in these terms excludes warranties or consumer rights that cannot lawfully be excluded.
12. Limitation of liability
To the fullest extent permitted by law, Vivanta Love will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits or data, arising from the website or an order. Where liability cannot be excluded, our aggregate liability relating to a product or order will not exceed the amount paid for that product or order, except where applicable law requires otherwise.
13. Indemnity
To the extent permitted by law, you agree to indemnify Vivanta Love from third-party claims, losses, and reasonable costs arising from your unlawful use of the website, your violation of these terms, or content you submit that infringes another party’s rights.
14. Force majeure
We are not responsible for delay or failure caused by events outside our reasonable control, including carrier disruptions, natural disasters, severe weather, labor disputes, governmental action, epidemics, power or network failures, or supplier interruptions. This does not limit any non-waivable cancellation or refund right.
15. Disputes and applicable law
These terms are governed by the laws applicable to Vivanta Love’s establishment and operations, together with any mandatory consumer protections that apply where you live. Before filing a claim, please contact us and allow a reasonable opportunity to resolve the issue informally. Nothing here limits rights that cannot be waived.
16. Severability, waiver, and entire agreement
If a provision is unenforceable, the remaining provisions remain effective. A failure to enforce a provision is not a waiver. These terms and the policies incorporated into them form the agreement regarding the website and orders, except for any additional terms expressly accepted at checkout.
17. Changes
We may update these terms prospectively. The version in effect when an order is placed will generally govern that order, unless law requires otherwise.
